Legal Question in Banking Law in India

i gave rupees 15000/- a person before 3 years ago as without any receiving the concerned person gave me a cheque from ICICI Bank in respect of payment of above said amount and the cheque had been bounced 3 times due to insufficient fund in account during the bouncing period i gave a personal written notice that person that your cheque has been bounced 2 times but the person didn't any reply after ward i have to take legal process and also send a legal notice few weeks ago but that person now regularly saying i had already paid to you aforesaid due amount definitely telling a lie. I have only one way that i file a case to court but i don't know that shall i win the case or not.

So please tell me that the period of finalizing case and is there any legal charge to me? if the person turn the table over to me as he is saying i will trap you in the case .

filing a case before the court u/s 138 NI Act would be the best way to recover your money.. You may also add section 420 in your complaint and show his illintentions...

The court would deffinatly take the congnizance and summon him to appear before the court.

You will recover the money for sure.
