Legal Question in Banking Law in India

nominee

my uncle had a s.b account with a nationalised bank.He had opened this account years back and he had nominated my brother as his nominee.But uncle had no papers with him to sustantiate this sincethis was years backbefore computerisation.My uncle expired last year and my brother send the death certificate,his identity proof,copy of signature duly attested,unused cheque book etc to the branch.They refusd to pay the amount saying he has to give the nominee registeration number.The bank had never sent my uncle any number regarding this.Under this circumstance,what can v do to get the amount from the bank?

There must be some proof as to nomination.

Hello.

You may issue a legal notice to the Chairman of the bank which claims the abovesaid amount.

Depending upon your location, and other assets of the deceased, you may need to obtain a certificate of inheritance from the concerned authorities.

nomination form should be available with the Bank. Issue legal notice to Chairman of the Bank claiming the amount. Failing proper response, file complaint to Bank Ombudsman of the Region u live.
