Legal Question in Banking Law in India

i have purchased plot at mundela kalana in delhi after some time the property dealer converted the plot in isa hedi in haryana border by his agent now the agent run away with money for some people previosly the property owner says that he had been responsible for these happening now the property owner is not taking interest and says that first of all call that fellow to whom you have given money. however i have given cheques for one lakh fouy thousand out two lacs seveenteen thousand by the name of property owner now i am saying that you return my one lach forty thosand as was given to you by cheque as was cleared by bank account entries are there, bot property owner says that he has two lacs eighty thosand of public whch he has accumulate through cheques by that agent he will distribute these amount among the parties of that agent. now my question is this if property owner will not acceded to my request for one lakh forty thousand out of two lakh seventten thousand in that circumstances I will intiate in which court and what are their steps to proceed please tell me

you may file a suit for specific performance against the actual owner and also seek stay against the property. you may see a lawyer for the purpose.
