i Purchased a House in 2008 that have a common wall with My neighbour house , Now he has demolished his house for reconstruction . He wants to demolish a common wall that 13.5" thk. he is saying for his 6.5" wall . can he demolish his half part .

also he is asking me for to purchase his half part that is 50 ' x 6.5" = 3 sq. yard .

can i do a sale deed for this 3 sq. yard or any agreement in between both the party that will be registered as per Govt Norms.

what is best way to deal

The query is not very clear. Why do you want to purchase his wall (3 sq. yd)?

If you purchase that, will he still not demolish the wall for redevelopment of his house? Is redevelopment possible without demolishing wall? If not, then your purchasing 3 sq yard would be of no use.

Best course is measure your property. If you find that half width of boundary wall (with land underneath) actually is in his ownership, then you purchase his 3 sq. yrd land by registered sale deed by clearly detailing in sale deed that it is common wall. At the same time, get a written confirmation from him (preferably in sale deed) that he will raise boundary wall in his own land and will not claim any right in existing boundary wall (and land underneath) which you are purchasing.
