sale of house

Dear Sir,

I am living in a house which is a co operative society house on my fathers name. The land was purchased on my fathers name from a co operatives society. when the house was constructed I also contributed in materials. I have all the bills with me. But now my father wants to sell the house and if he sells it I will be homeless. My father is retired Central Government officer and wants to transfer all the money to my younger brother.

Can I have any right over the house. Can I object to the sale and if so how to prevent secret sale.

You have not mentioned as to how much is your contribution towards construction cost?

You do not have a share in the property. At the best you can demand from your father return of the amount spent by you as a 'lien' on the property.

In the court you will have a very weak case. Better you settle the matter amicably with your family.

I have gone through your question. As you said that the above house property was in your father name. You also said that you have contributed some amount while construction of house. Answer to you question is.

1. That your father can sell house property which is purchase by himself or he can gift the above house property and money to any body as he likes.

2. You can only recover your amount which is invested for construction by filing a money recovery suit against your father.
