sir my name is shruthi, our family have 13acrs of land which we got from grandpa when our father family got devided, now with out my signture my dad and brother has saled the property, i need to know that if i case a file will i get that property back or what

If the property is ancestral one, the sale proceed will be invalid. You have many ways to get back the property.

You can challenge the Sale Deed within 2 years from the date of its registration or from date of knowledge of sale OR

If possession is with you, u can move for injunction OTHERWISE

file recovery of possession

OR simply u want to raise a suit, file suit for partition

The above opinion is wrong by my learned friend as the law stands today is that the property of grand father ,given to father is self acquired of father and he can do whatever with the property . You would be wasting your time,energy and money in hoping to get that property which never was yours. If your father had died intestate ,then you would have one share amongst all the legal heirs of your father.
