unlawful acquisition of land

a piece of land i own was unlawfully acquired(without declaring award) by a certain land development authority, the case is being fought in court , i am claiming

that compensation be given on the maximum rate that the authority has sold land to other people. have there been other judgements like this in the past , if so where can i get a copy of the judgements , and am i on the right path.thanks and regards ashish

You can file a Petition in the court of District Judge under Section 18 of the Land Acquisition Act for claiming compensation at the rate you want. But, as regards the rate, you would have to convince the court, by leading evidence, that the rate of land on the day the notificaion under Section 4 was issued was 'x' amount. Then the court may grant said rate to you. There are numerous judgments related to Land Acquisition. you may search these on supreme court website.

You may want to refer to a good work on the Land Acquisition Act and more particularly refer to judgements under Section 23 of the Act.
