Already vehicle finance cleared, R.T.O office issued clearance certificate, but finance company take him lorry again filed injuction suit, lower court granted temporary injuction, after hereing lower court ordered directly lorry handover to the defendant ( lorry owner) , and gave under take before the Hon'ble court. finance company again filed CMA, the higher court heared both side orguments pass decree and order. 1st point finance company directly handover the vehicle to the defendant, 2point set a side the lower court order no necessity to undertake before the Hon'ble court. Decree two points separate, but order two points clubbed. Whether decree maintainable , or order maintainable
