Name Change

sir,i m a student doing my graduation and i want to change my name,can i change my name in general and in all my necessary documents as well,such as my marksheets,license,passport etc.i m not much sure about what legal steps should be taken to do so and what should be the procedure which should be followed that i should not face much problems after changing my name.

Dear Sir,

This is with reference to your letter dated June 14, 2003.

In order to change your name you need to make a declaration in the affidavit duly notarised mentioning therein all the particulars and effective date.

Next thing to follow is to publish the same in the daily news papers. As far as the change is concerned in the marksheets you cannot do so, but wherever these documents needed in future you shall attach a copy of the affidavit and the news paper cutting with them in order to avoid confusion.

In case of passport and license you can ask for re-issuance of the passport or license from the concerned authorities but it will take the same time and procedure as it takes to issue a fresh one.

In every State in India the respective State Govts. prescribe the procedure, which include the declarations as to whether the applicant is involved in any criminal cases. After complying the procedure prescribed,the District Magistrate would issue a certificate, whereupon the applicant should get a public notice inserted in two newspapers one English and another vernacular. In addition an advertisement has also to be got published the State or District Gazette. After gazette publication, sufficient original copies be purchased, and then the applicant should reuest the concerned authorities to effect changes in certificates, marks sheets, passport etc.

To change your name,you have to make a declaration in the form of an affidavit giving among other things, your present name, your new name and address and get it notarised by a Notary Public.

You must also advertise the change in at least one English and one regional language newspaper circulating in the city or town in which you are living.

If you are in Maharashtra, you are required to apply to have the declaration inserted in the State Government Gazette.

Once you have done all the above, keep about a dozen copies of each of the above, i.e., affidavit, advertisements in newspapers and the copy of the State Government in which the change is published.

You cannot change the name on the existing marksheets, passport, etc. However, you can apply to the University to register your new name and to issue future marksheets, degree certificates, etc. in that name. You will have to follow whatever procedure is required by the University.

As regards changing of the name on your passport, apply to the passport authorities. They will probably treat it as a fresh application for a passport and follow their normal procedures for issuing the same, such as police inquiries, etc.
