Legal Question in Construction Law in India

My brother a NRI and 23 others purchased plots in a layout at Chennai , from a vendor who visited Dubai, Sale deeds were executed and cost of registration was included in purchase. Later all entrusted to the same vendor the task of bringing up houses in their plots and construction agreements were signed with a specific note that the vendor will d all dealing with local authorities in the connection. Cost of construction was worked out and it did not specify nor the vendor demanded money separately for procuring documents like sub division, NOC neither for construction nor for building plan approval and competition certificate. None of us were aware of the local procedure. The vendor delivered my brother�s house saying it was ready for occupation when he visited Chennai. He could not occupy the house because there was obstruction from local authorities that the vendor did not get approval for construction. The vendor conveyed to my brother that he had not bound to get the papers. My brother had to employ a third party and spend money. Can my brother sue the vendor legally for hardship?

One may file a complaint against the vendor before consumer forum and claim damages.
