Delay in delivery of consignment

My client has sent a consignment which contains Tender documents through a Courier company, with written instructions on the consignment to deliver the same within a specified time. The actual delivery was delayed by more than 5 hours. Due to delayed delivery my client could not participate in tender submission. What are the claims that I can make against the courier company for defeciency in service? What are the documents that I require to substantiate my claim?

The courier companies usually print their disclaimer clause on the backside of the reciept given to you at the time of booking the courier. The disclaimer clause contains all the clauses of agreement between you and the company. If the company had agreed to deliver the package at specified time, then you can surely file a complaint in consumer court.

Relevant factor would be what was agreed and not what was instructed. If the Courier company had accepted the parcel to deliver the same within specific time limit, then Courier Company can be held responsible for delay.
