Legal Question in Consumer Law in India

Facts:

a) We purchased a new school bus for our school 4 months ago.

b) From the time of arrival it has been breaking down almost every week, causing great inconvenience to students, parents and school management.

c) The dealership sends a mechanic to the site to fix the problems, but never gives anything in writing or any bill, saying the work is covered by warranty. The owner & manager of the dealership do not answer our phone calls when they see our number, they simply ask the mechanic to call us back.

==> Our suspicion is that there is a serious manufacturing defect in the bus causing it to malfunction & break down every 6-10 days. The problems are varied, ranging from electrical, mechanical to body work. We would like to know the esteemed member's opinion if a suit can be filed given that we have no written record of the constant breakdowns. How would the onus/burden of proof be shown in such a case? Can we file a case making both the dealership & company jointly liable? We would like the dealership/company to provide us a new bus. Thank you.

you can file a case in consumer forum against dealer and company making them as respondent 1 & 2.
