Legal Question in Consumer Law in India

Hi,

I have a old nano 2010 that I drove 26000 km without any problem.

I got my second nano 2012 and within under a week; multiple issues started coming. The car is in workshop for 5 days.

Problems

1) Engine oil light turn on and car engine stopped completely in the middle of the road while going at 50km/hr in 4th gear. In 10 seconds this happened 3-4 times. I got sudden jerks in the car when engine light was ON and thank god some accident did not happen.

2) The car ignition motor is not working properly. Sometimes you have to start it 3-4 times

3) Not even a week and suspension was also defective for the left hand side.

4) After driving for half-an-hour; if you start car from 1st gear; you have to give a lot of throttle to move. If you don't the car stops and you have to start again.

TATA gave me a defective car with no QUALITY CONTROL ON THE CAR.

Within a week so many problems I am facing.

How can TATA sell a defective car to a consumer and expect to change everything in warranty in less than a week?

They changed the following

1) Left Suspension

2) Starting Motor

3) Engine problem came because of a temperature sensor that they reset.

4) They tweaked the brake, accelerator and clutch so that it should start fine in 1st gear.

5) Brake Oil topup within just a week!

At the time of delivery TATA gave a defective car and did not checked suspension, start motor and temperature sensor. In 1 week how come so many problems can come in a new car?

I want to get my money back.

Since I have one old nano 2010 I know these problems do not come.

TATA gave me a defective car with NO QUALITY CONTROL CHECK.

You cannot sell a defective product to a consumer. The car has lost its new feel.

Before I proceed further I need some advise.
