land occupied

My father is a retired Ex-sub/Major (army).Now he is at the age of 64.

During his service Government has given 400SQ.Yards of land to all the solders who had participated in the war, on the payment of Rs 5000/-, in the Year 1984. In the same area they had given land to around 80 members.

Now the problem is, someone has occupied the land, removed all survey stones and Pass book is also done by them on our land by there name. Since 1984 we did not paid any taxes on that land. All the land was open area.

So what should we do, to handover the land?

There are some crucial questions.

Did you pay Rs. 5000/-?

Were you given possession of land?

Was the land mutated in your name?

Do you have proof of all the above?

When did you come to know about the encroachment on your land?

What action you have taken so far against encroachers?

Why did you not pay taxes since 1984?

Did you get tax demand notice from the municipality? Till when?

Proper legal advice / help can�t be given in the absence of the above details.

Write to concerned govt. office who made the alloment with the request to demarcate your land allotted by them and thereafter possessed the same and in case if the same found in possession of any person(s) than made the request the govt. official to remove the encroacher. This is the best way otherwise you will be in trouble

Do u have all the documents regarding the allotment of land in your favor. If yes, then write then letter to the concerned authority and enclose copies of all such document, and request him do the needful, to restore the position.

Firstly get the latest position of land also the status.You have to file suit for possession to get back your land.Consult a lawyer of your area with all details or you may also contact me in this regard.

file complaints to the local police with copy to commissioner

file suit for possession. the department which gave u the property should be made party to it.
