Legal Question in Consumer Law in India

In a recent case State Commission Consumer Forum had set aside an order of a lower court that considered one citizen as a consumer in the ambit provisions of Consumer Act in allowing a case on some irregularities in collection of Tax by municipalities. The order of the State Forum seems in order.

I have seen Commissions coming heavily on municipality/corporation on deficiency of services when challenged by citizen forums.

Can I take the citizens will be considered as consumer if what is given monetarily or otherwise by them is for return of specific service expected to be rendered by the statutory authorities like corporations ? My case is coming for hearing on similar lines on 22nd oct.

unless you state what your case is, it is not possible to opine. but the commission can issue orders against municipalities and corporations.

Your question is not very specific. A compnay/corporate or other bodies may be

treated asa person. in many cases, or forum can be treated as persons,it depends

uopn interpretation and considering the nature.

If you are pleading through your lawyer,he will put reference recently like so

many cases appeared in newspaper headlines.Ask him to put from law journal.
