In our society, Builder has sold the parking slots to members. These members pay municipal tax on the parking space. Can society start recovering the maintenance charges on such parking spaces, from members? if yes, under which law? Kindly guide

Dear Sir / Madam,

Although the Builder has sold the parking slots to members, they still become liable to pay for all the common amenities like sweeping and security. It is well within the Society's right to start charging maintainence more appropriately called "Parking Charges" on such parking spaces inside the Society compound, by passing a resolution to this effect in the General Body meeting of the Society.

In fact, many Society levy Parking Charges of Rs. 300/- per month per vehicle and Rs. 150/- per month for a two wheeler parked by members inside the Society compound.

Yes. You can ask the members to pay the maintenance charges as per their occupied areas.
