Legal Question in Consumer Law in India

I am staying in the 1st floor of a socity in Navi mumbai. water is leaking from the second floor flat bathroom and is coming on my bathroom . I have taken up the issue with the owner of the flat in 2nd floor and told him that i 'll bear the cost if required and also with chairman /secretary of the soceity but in vain. Secretary could not convince that owner of 2nd floor flat .
owner of 2nd floor flat says he does not have time and he can not get it repaired since it will be closed for use and he does not want to co-operate.
Now i am in a real problem pl guide me how go about it .How to escalate the issue and how to get the leak attended.

approach the local court and file a case against society memebers and second floor owner with a prayer to direct them to rectify this problem.
