Cheque bounce

I have received a part payment vide cheque from my debtor and the cheque is bounced for the reason '' drawee's Signature differs''.

Can I suit a file against him?

The situation is rather delicate as the reason of cheque return is technical.If the relation with your debtor is permanant and close it is ridiculous for you to take such astep.Moreover it is not a case of insufficient funds in the debtor's account but a mismatch of his signature.So the case could be solved amicably and if the debtor refuses to issue another cheque and then you are advised to take up the proceedings to the court.
