Legal Question in Credit and Debt Law in India

Dear Sir/Madam,

A few days back I had asked a question whether a complaint filed under Sec 138 of NIA for a dishonoured cheque of a co-op. credit society issued by a company to whom I had sold goods (for which I have the necessary documents to prove) is maintainable or not.Your legal advisors were very kind to reciprocate and had replied in the affirmative( i.e case is maintainable).I would like to know if there any precedents(judgements/rulings) in favour of such cases?

It will help me a lot if I can get any info. on this.

With Best Regards,

Vishwas

you may simply file the complaint and as you have the documents with you, they would amply prove your case. apart from filing a complaint u/s 138, you may also file a civil suit for recovery u/o 37 of civil procedure code. regarding judgments, its the job of your lawyer and not you to collect them.
