Property Brokerage

1) I have purchased a flat thur' broker where the agreement value is less than the actual cost of flat.

2) It was decided to pay brokerage of 2% with the understanding that there will be negotiation upto 1% as the property value is more. We have signed on simple paper stating that we will pay 2% brokerage.

3) The broker didn't help us in completing the formality, so we offer him only 1% brokerage. But as he refused to give us keys of the flat, we gave 2% brokerage amount cheque.

4) Now since I got the key, I have issued stop payment instructions for the cheque.

5) Pls. advice me if the broker can take any legal action against me. What is legal correct thing to do to save the brokerage amount ?

give him the notice that the amount of cheque is not due to him so replace the cheque with the one with lesser amount from you.
