Citations by Supreme/Bombay High Court re CrPC S 439

Charges: IPC Ss 380, 420, 467, 468, 471 (under one court)

Name of accused not mentioned either in FIR/complainant statement

Delay of nearly 10 days in lodging FIR

No evidence/reasonable grounds to believe accused guilty of the offence. Complainant has no personal knowledge of the accused commiting the offence. No direct evidence/ eye witness.

Bail rejected by the Sessions court on the basis that accused may temper with the evidence.

I need orders/citations by Supreme Court or Bombay High Court (along with their respective years) re this matter for filing bail application again.
