Legal Question in Criminal Law in India

Nri and 498a

I am a doctor in UK got married to an ex judge's daughter last year who went back to India and lodged an usual 498A complain. My family members have got the bail but I am in UK stills and do not know what to do now. so could anybody let me know the proceedings from the police side as well as from the court regarding securing the presence of an NRI for the police investigations/trial in India?

You would be issued summons by the court. If you do not remain present on that day a warrant of arrest would be issued. Even if you do not subject yourself to the court then you may be proclaimed as absconder and your properties in india would be seized/sealed.

1. The police may obtain your arrest warrant from the court and send the same to the Indian High Commission in UK for execution through local authorities.

2. The Court may declare you a "Proclaimed Offender" if you are not produced by the police despite arrest warrants.

You are appearance in court in India may not be really very harmful; however, the court may impose conditions like 'not leaving the country (India)' during the pendency of trial.

Therefore, you may consider an amicable out of court settlement of the entire dispute and try for a mutual consent divorce.
