Legal Question in Criminal Law in India

Hello Sir,My Brother is charged under IPC 408 for 12 lakhs of misappropiation of stocks in his retail showroom where he was working as a manager.He is now in JC till 7-7-12 and one bail is already Rejected in Lower Court.Now we are planning to appeal in Session Court for same.Please help me the chances of Bail As nothing recovered and no other accused has been found yet by Police and My Bro is innocent Please Advice.

Hello

Bail is completely a matter of discretion of courts. Bail depends upon many factors i.e. Judge, Lawyer, Facts, Investigation Reports, and others.

So, instead of wagering on chances, you should apply for bail to sessions courts, and if sessions courts deny bail, then apply to high court.
