Legal Question in Criminal Law in India

I am trustee in a trust, the co-trustee never attended any meeting from last 13 years suddenly a m.o.u. is signed for a particular property, he goes to a Magistrate court and filed complaint to register is F.I.R. under section 153 (3) under criminal acat.
