Legal Question in Criminal Law in India

Warrant for not appearing at Court

Sir, while I was working with my previous company, I had signed a document as per the instruction of my then boss. But the document turned out to be invalid and called as 'forged'. A case was filed against me. But as I left country for another job, I could not appear at court when the case was called for. Now a warrant has been issued against me and am told to surrender. Please advise the consequence and future proceedings. How can I get a bail without being arrested? Will there be any issue at airport when landing? Should I be held responsible for signing as it was done for company and upon my boss's instruction? Please help.

Re: Warrant for not appearing at Court

you need to file an application through your lawyer for the grant of bail in the above matter. you didnt mention the case pertains to which state. do mention that and hire a good lawyer to save you from harassment.

Re: Warrant for not appearing at Court

as per the law you will have to appear before the cour and get warrant cancelled first and hen ask your lawyer to get permanen exemption of yours otherwise if proclamaion is issued hen you can be arrested at he ime you reach airport, you should give all he instrucion o your lawyer regarding he pracice in your company in which you were asked by your boss to sign the documents. the circumstances under which you were made to sign the documents also plays a vital role. your benefit in signing he document will also be considered.

You can try for anticipatory bail. The facts stated by you are not sufficient to comment on merits of the case.

Re: Warrant for not appearing at Court

dont worry. immediately contact a lawyer of the area where the case is and ask him to get the court record and then consult him.

its impossible to advice in this case without going through the papers.

you can stay at ur place and may be arrest is not required if the case is not that much serious.

a lot of things can be done and if its in delhi then u can contact me immediately.

For furter and detailed advice please contact me personally with documents (if there any). Consultation charges will apply.
