reservation in educational institutions foe sc and st

i want to know that is it necessary to fulfill the reserved seats for sc from sc candidates only in engineering colleges. if seats are remained vacant because of lack of students, do the college can give admission to a sc student who have lower markas than minimum eligibility markas ? i am a engineering student. i want to take admission in engineering college but i have less marks than minimum eligibility marks.i am a sc student.please give me advice that if seats remained vacant and college convert them to general seats and does give me admission ,can i do a court case on college for this action. please give me guidance. thanka a lot

To some extent, the answer to your question would depend on the State in which you are, and rules and regulations of the university under which the concerned college is fucntioning. Generally speaking, there are provisions which enable admissions to students of SC/ST community who pass the qualifying examination, though they do not have the requisite minimum marks. Please clarify the position in your particular case. The practise however varies from university to university.

The handbook/prospectus for admission or entrance examination usually contains the relevant info, with numbers and dates of relevant government notifications and/or directions on the subject. Please refer to this and let me know whether there are any such directions.
