Legal Question in Family Law in India

498a has been filed against my relative who is a us citizen and is in India right now. He got bail, but he needs to come back to us otherwise he will loose his job and his home. His kids are in US right now. Can he get the permission to come bact to us. What is the procedure for that?

in case he has got the bail, he can go anywhere he wants, after seeking permission from the court where the case is pending. hire a good lawyer and he would get you the permission.

If his passport has not been seized by the police or deposited with court, there should be no bar on his travel plans; during trial he may seek exemption from personal appearance till the case is reached at final stage.

A US citizen may also seek help from the US consulate in India for expeditious settlement of the matter. You may also make efforts for out of court amicable settlement of the entire dispute to avoid delay and expense.

If his passport has not been deposited in court, and bail is not specifically conditional that he will not leave India. he may go where ever he wants. but b4 leaving he must inform the court for so stating duration of travel
