Crpc 125

I am living seperately from my wife for last 6 months and I filed a case under restitution of conjugal rights at karkardooma court delhi but when summon was issued to my wife, her mother refused the summon and filed the case under CRPC 125. On first date Judge has forwarded the case to mediation cell and date is 15.12.2007. How can I solve my problem. the next date of Section 9 is 28.02.2008.

Please advise how can solve my problems.

The amount of maintainence depends upon certain factors like status,income,no of dependants on you etc. So without having all facts it is not possible to advise you.

Your wife has no independant income so she has got right to maintenance..

arre brother if you want to finish it off then you have to fight the case and there is no other solution but if you are willing to live with her then try to engage a genuine advocate and take the reconcilliation proceedings seriously.

if god helped and senses came back to her then she will return otherwise the mind of women is like this and no one can help.

In any case, if the wife does not have any independent source of income, she is entitled to maintenance.

Even in your petition u/s 9 of HMA, she can claim not only maintenance pendente lite but also litigation expenses.

it is better to volunteer payment of maintenance without contesting 125 CR.P.C. application.

If you disclose me your income honestly, I may suggest you the maintenance amount.
