Divorce case for 3years

Hi,Iam a boy from Bangalore.I got married to a Hindu girl in 2002.We were together for 10months,from then we are staying separately as we were not happy with our marriage,Then I filed a divorce petition in 2006 and now the girl is not accepting for divorce as she is not interested in it.The case is running in court since 3years and still we are unable to solve this.Pls guide me how to get divorce from her as it is already 7years of marriage and we are staying separately.

We do not have a "no fault divorce" theory in India. You have not mentioned the grounds on which you are seeking divorce.

If sufficient grounds are not existing in terms of the Hindu Marriage Act, you may never get divorce without her consent.

You may consider reaching an amicable out of court settlement with your wife for securing her consent. Otherwise, you may not get divorce.
