Divorce

Dear Sir

I got married in May 1997 in Delhi.Wife a Govt. Teacher.Me a Sales Person.Fighting on small matters from the first day.Unable to adjust. Had a son born in Oct.1998.Seperated from Wife in July 1999.Child is with her.Wife is not giving divorce after many attempts to persuade her.No communication with her since July1998.What should I do ?

your only remedy is to obtain divorce on the ground of desertion and cruelity. You can also go for the custody of child. Remember you can not force her for divorce.

File divorce petition on the ground of cruelty and desertation.

I advise you to make all attempts to reconcile with your wife, before going for divorce.

if you have space for reconcilliation they try for the sake of the child otherwise you can file on the grounds of cruelty and desertion.

your son is 9 years old. please write in detail your communications/meetings with your son; do you know in which school your son is studying? what persuations were attempted - please provide me complete details?

the matter is a little more complicated and deserves delicate handling; please do not consider hurrying up for divorce; may be the child can help uniting the two of us.
