Legal Question in Family Law in India

Hi,

I have divorce case, I married before 10 months in india and staying at India.

I am IT professional.

I am right now at Singapore,

I am getting my Basic salary in INR 13000/- and remaining in Singapore Dollar $4000 (SGD), which is not too much as per Singapore living cost.

Now if i need to pay 1/3 of my income , what income would be consider ?

If Singapore income is consider than it is too less and only for Food,Travel and house not more than that.

If i settled out of india then 1/3 of what i need to pay ?

it is not for u to chose from where to pay. as a husband u will have to pay as per your total source of income. try to settle your life. just 10 months is a too short period to decide.

calculate your total income in INR. There is no tight jacket formula for fixing alimony. You may place entire facts before the court and court may consider in accordance with your income and expenses ratio. One third is NOT the rule. The maintenance is determined as per a decent standard of living depending upon finances of the parties.
