Legal Question in Family Law in India

Hi

My husband has left me almost 6 months ago and he has decided he doesn't want me anymore..He has decided to go legally and file a divorce petition. But i am not ready to give my consent to it. and he is absconding and staying in a different city.. unable to trace him also.

Can i ask for my conjugal rights and waht happend if i do not give my consent? what best can i do to save my marriage?

as your husband already left you, it clearly shows that he is not willing to stay with you. you may seek other remedies such as return of your stridhan or alimony and go for divorce by mutual consent.

u can file application for restitution of conjugal rights u/section 9 of the hindu marriage act. under the same proceeding u can ask for maintenance also. consult a lawyer but never loose ur own wisdom. try social methods also to bring ur husband back.

The best way is file a case of Domestic Violence Act and demand to stay in his parental house and court will allow you to stay in that house and thereafter he will himself come back to the house and you will get together again.
