Legal Question in Family Law in India

SHE should inform about my SON'S whereabouts

Our 10 yr long marriage has failed.Divorce is under consideration. My wife takes my 6 yr old son to outstation

for 10-15 days duration without leaving any information about location, date of return etc.His education and health is suffering and she is about to take another such trip , I came to know. I sent e-mail to her asking to take my consent for any further travel of my son.

Can I register a FIR at police station ?

Suggest how this can be stopped.

Presently, we are staying in the same house. She doesn't care musch about his well being. She hardly spend 1-1&1/2 hr a day with my son - after office and TV. I do all the chores of my son who is very much attached to me emotionally.

Pl answer at the earliest. I must stop my son being taken away with out any information to me.

Thanks & regards.

Re: SHE should inform about my SON'S whereabouts

To me the only remedy appears to be that you file for divorce in which you also file for custody of your son. After filing for divorce, an interim application for such custody may also be filed.

Yes, FIR may also be filed, but wouldnot be effective. However, such FIRs will be useful as evidence of your wife's behaviour.
