in case you want divorce, you need to file a petition for divorce and for that you will have to send a power of attorney in favour of your lawyer and the POA should be duly notarized by notary public and in case the notary is unavailable, it should be duly attested by the indian consulate there. after that only your lawyer is empower to pursue the case on your behalf.

Filing for divorce on grounds of cruelty/ adultery etc will be based on facts and evidence specific to your case. Even in absence of direct evidence, you can still file for divorce.
