Legal Question in Family Law in India

precaution against dowry case

Dear Sir,

I belong to Jamshedpur and got married in Meerut city in Uttarpradesh in 12th March,2004. Since I am not having a good relation with my wife, to keep my parents safe, I am staying in Meerut since last one year. Still she is torturing me and threatening me of filing a case of dowry against me and my parent.

So my question is:

A) Can I ask my parent to make an afidavit saying ''I dont have any relation with my son and we are not responsible for anything''. Just to make my parent safe from harrassment since they are very old.

B) At the same time I will hide anywhere in India.

What will be the consequeces in case of a ''case of dowry'' against me in such circumstances?

Thanks and Regards,

abc

Re: precaution against dowry case

If your parents are not involved in any dowry demand and/or torture of your wife, there will be no harm to them; probably even a case may not be registered against them; more particularly if they are living separately from you, there cannot be any action against them;

hiding is not a solution; better you try to settle the matter amicably by making efforts for a compromise.

Re: precaution against dowry case

If you are staying seprately from your parents then there can be no case registered against him under dowry demand or mental harrasment. So keep that worry aside AND Settle the dispute with your wife amicably by putting in efforts yourself via media for a compromise. Hiding is not the solution to this.

Re: precaution against dowry case

Are your parents living with you ? If no don't worry.Second thing from my experience in law field i can say filing a case is one thing but proving the case makes all the difference. if you are innocent she will not be able to prove her case. No need of hiding. Instead if possible settle the case amicably.
