I want to get relieved

Hi,

My husband is a veru crooked and sadist fellow who made me to suffer alot. But he acts very good in front of everyone so that he gives an impression of a very good man and behind the walls/ in our bedroom he physically and mentally harrass me. Even when i was pregnant he use make me sit thru out the night thought he knows i have to take care of household works and then go to office. Even after a child's birth he dint mend his ways. he pushed me out of house when i was 5months pregnant. since an year iam with my parents. When i asked for my clothes and other belongings of mine he said he will not give them to me at any cost. Now he is asking for divorce. I dont have any support from my people so iam thinking of wether to file498 or not. He still dont realise his mistakes. I have a girl child. If i file a case of 498A after coming out of police station if he trys to harm me or my family what should i do? As a preventive measure can i file a case that if something happens to my family and me he should be held responsible? Few advises me to just give divorce and be happy as i have to take care of my old parents and a child and has to work. Iam in such a helpless condition. Please advise

depending upon income and assets of your husband, you are entitled to :

(a) maintenance for yourself and support for your child; under Hindu Marriage Act;

(b) return of all your "istridhan" - all your belongins, valuables, shaguns etc. given to you by your parents, relatives and in-laws, during marriage; as also the expenses incurred on marriage;

(c) adequate compensation for the damages suffered by you - mentally and physically; and a right to living accommodation under the Domestic Violence Act.

(d) registeration of a criminal case against your husband for beating you and for similar tortures;
