Legal Question in Family Law in India

sir

my marriage performed in 2007.

my husband has stopped filing of IT return to conceal his assets/income and closed his bank accounts before filing /after filing the divorce petition.

that's why I am asking the court to direct him to submit his Full disclosure of financial statement in affidavit From 2004.

My husband has purchased 3 flats 5 Acre agricultural land before marriage and now he is saying he was living on rent before and after marriage.

Sir as cabinet has passed in March 2012 that wife will be entitled to get 50% of the immovable property as below:-

Woman and children will have 50% share in the residential property of a man in case of a divorce

 The wife will have to move an application seeking the share in such cases

 It will not matter whether the property was acquired before or after the marriage

 Women and children will also have right in the movable assets of the man

Q1-- Can I get financial statement affidavit since 2004 or not ?

Q2whether the above cabinet decision is implemented or not ?

Q3I have no child, shall I get 50% of the share or not ?

Cabinet has passed - but it is yet to be passed by Parliament, and then it needs to be notified, still a long way to go.
