Legal Question in Civil Litigation in India

I have applied under RTI ACT 2005 for furnishing information regarding EPF of my husband from Regional commissioner EPF on a plane paper afixed with court stamp of Rs 10/= as advised by my friend. but CPIO has asked me to pey fee through demand draft or IPO. He has mentioned in his letter to me that third party information cannot be disclosed. Why he has not furnished requested information? Can not I seek EPF information about my husband? Please advise.

You shall make RTI application only by IPO or DD. In Gujarat state, application on Non-Judicial Stamp Papers is also entertained. But court fee stamp is not proper mode of paying fees under RTI.

And EPF officer is correct in stating that third party information cannot be given to you. For EPF officer your the thrid party and hence he cannot disclose the information of your husband to you.

If your husband is alive, you may not be entitled to seek information about him under RTI Act.
