rent eviction case is pending in distt.courts,chandigarh.i am tenant and i paid rent at the rate of rs.1000/-p.m. till 31-03-2007 as per provisional assessment made by the rent controller.now,the the lanldord has filed another rent petition on the same matter and issues and further cause of action as claimed by him.but,in the fresh rent petition,the landlord is claiming rent at rate of rs.4000/- p.m. w.e.f. 01-06-2002.,wheras in the pending petition,all rent till 31-03-2007 has been tendered in cash in the court.also,civil suit for reovery of electricity dues w.e.f.01-01-2004 as claimed in pending petition has been filed fresh.this is total abuse of law.should i file application under section 10 of cpc for for staying the proceedings and in which court,apppellate or the same court.i am totally under stress now.i have also filed caveat in the same court in chandigarh so that the landlord should not obtain ex-parte order for my forcible and illegal eviction in any case.the landlord has no rent agreement and proof of rent as rs.4000/- p.m.,while i have the solitary rent receipt given by previous deceased landlord showing thge rate of rent as rs.1000/- p.m.now,the new legal heir is saying this receipt to be forged and fabricated .

you can fight it out. you can ask for joinder of cases but u can not ask for stay (as per what i could understand from your submissions)

you can also ask for the same date in all cases.
