dues of father - reg.

My father was working in a govt deptt and retired from service in 1991 and died in 2004. Received a letter from Collector of Trichy, during my father's govt. service, there was some recovery stating that pending unadjusted amount of Rs.57563.68 and i (only son and five daughters) have been directed to settle the dues now and I recd the regd letter on 09.10.07 and also advised to meet the Collectors Office, Trichy. I understad that the above amt were adjusted against DCRG, while settling the retirement dues of my father. Is it proper to approach me for the above dues, even if it so (being the only son) and (ii) i have not claimed even a single pie towards his death benefit, etc. Pl advice, what is to be done?

if you have taken any benefit of fathers property then you are liable otherwise not.

you can save yourself comfertably

At least you must know the truth.If you had received any property or ammount of your father then your liability is limited to that ammount or value of your father's property.

I think you are not aware about the factoids. your liability remains limited to the property you have received.

If the amount is adjusted from the DCRG, there is no question of revovery from the legal heirs,..You have to veryfy and confirm the fact of adjustment from the DCRG....again if u have inherited assests from your father, then you will have the liability to pay off the father's debt,...and your liability is limited to the extent of assets that have come in to your hands by way of inheritance..you may contact the offcials for the clarification of the correctness of the liability of your father.There is no cause for any worrry..

It is better you try to know whether amount has been paid by your father or not. Limitation Act Provides Limitaion for all purposes of recovery of amount in view of the same your case also falls in one of the category. If the limitation Act covers your matter then no needs to worry of about. Just approach to a counsel with details of your case particularly the exact dates of dues pending against your father. The point should be stressed in point of limitation.
