Legal Question in Civil Litigation in

Can a housing society levy legal charges from the member to litigate issue from the respective member.? If so the member need to foot two legal charges for the litigation .one to his lawyer and other whatever housing society spends.

What is the order passed on this by Mumbai

high court or co-operative court.? The general body has passed a resolution on this and is this legally valid as this infringes ones fundamental right to litigate

issues. If this is correct it will deter one to litigate against the co-operative housing soc. member to litigate against the wrong doing by the managing committee.

wait for decision of the court. the resolution is valid as when a certain member files case against society the other members need to collect funds for defending the litigation.
