Legal Question in Civil Litigation in India

I live on the first floor of a 10 floor apartment tower. there are two such towers and a co-operative society is formed since 10 years.

There is a water leakage in the master bedroom from the ceiling. The cause is the leakage in the bathroom underground pipelines of the second floor above.

The owner of the 2nd floor refuses to repair. what rights do I have. is this a criminal harassment case or a civil matter and which law is applicable.

Dear Sir / Madam,

You should lodge a complaint with the Society and request the Secretary to write a letter to the member residing above your flat to carry out the repairs to stop the seepage of water from his flat into your flat. If the Secretary fails to write the letter, you can then escalate the matter and send a written complaint to the Registrar of Co-operative Housing Societies in Pune.
