Accidental Compensation Law

A scooter covered with insurance got in an accident.Pilion rider succumbed to death.On behalf of her two daughters a compensation suit was filed against Insurance Co.

Will they be able to receive compensation?

it is to be seen that who was driving the scooter.

if the same was driven by authorised person or by the owner himself then insurance company has to pay the compensation.there are judgement that if insured vehicle met with accident then insurance company has to pay compensation.

It all depends whether the driver of the scooter was holding the valid & effective driving license at the the time of accident. The insurnace policy was in force/active at the time of accident. Whether the insurance company has charged the premium for the pilion rider. If the answer to all the questions is YES then the insurance company will pay else the owner of the scooter will pay. Whatever the claimants will be compensated.
