Legal Question in Landlord & Tenant Law in India

Dear Sir,

My Uncle was a tenant of a shop in Delhi. Later he purchased it from the owner through a non registered POA along with the registered will from the owner stating that after his death my uncle will be managing the shop. In this will it was not mentioned that the shop is sold to him.

Now my uncle has

1) Unregistered Agreement to Sell.

2) Unregistered POA.

3) Registered will.

4) Unregistered receipt of the payment on a plain paper.

Please confirm that if the owner of the property claim the possession of the shop.

you will have to prove sale if challenged by the seller.

your uncle may have to file a suit for declaration of ownership on the basis of documents in his possession.
