Legal Question in Landlord & Tenant Law in India

Hi,

I am staying in arented house.I did a rental agreement with my owner for five years on a 10/- stamp paper.This is not registered.I payed one lakh as advance.I have been staying for 3 months.The house is not at all good.Now I decided to vacate the house.On the stamp paper we have aincluded a clause likee when ever I feel like vacating the house I should inform him two months in adavce and the one lakh should be paid to me with in two months of vacatong the house.I have reciet of one lakh also from him.Now he refused to pay money back to me.Please advice.

you have no option but to file a suit for recovery of Rs. 1 Lac in accordance with the agreement written down the stamp paper.

If you are in Maharashtra i doubt how much the civil court may accept unregistered agreement as proof.

even if the document is not admissible, the tenancy may be considered as monthly; you may consider filing a civil suit for recovery.
