Legal Question in Landlord & Tenant Law in India

i was a tenant in a builing for last 1year, i have given an Advance for 2 months apart from this month rent is also given in advance, 7 there is no rental agreement between me & the owner. after 1 year that is on 2nd June 2011 the owner came to me with a slip written that the Rent is increased by Rs.1000/- , old rent is 4850/- including maintance& now increased rent is 5850/-including maintance from same month i.e., June 2011 itself for which I said I will not be able to pay that much rent, & owner replied if icannot pay that I should Vacate the house, so I told the owner I will vacate the house immediately on 7th june i.e., the date on which I took the house, and he asked me to vacate, & I vacated the house & I asked him to repay back my 2 months advance for which he said he doesn't have the money, & he will pay it back to me when a new tenant occupies his house, I asked him to give it writing to me & he has given in writing like this: that I have vacated the house without 2 months notice & I am aware of it & on my own accord but anyway he will give me back my advvance once a new tenant occupies the house, for which i insisted he should mention the advance amount also & he has written the Advance paid by me as 9000/-. Now on July 1st a new tenant has occupied the house & I called up the owner to return back the Advance amount due to me, he says he has not collected any Advance amount from the new tenants & they will give the advance only in the first week of August, then on my insistance for Advance he says that the house is vacant for last 1 month so he will pay me only 4500/- & that also in the second weekend of july. please note he has not given us any notice of increase of rent in Advance (normal increase in rent I would not have said no but since Rs.1000/- increase is abnormally high I said no & I cannot to afford to pay) abnormal. Please advise me as to what action I have/can take against him as per the law, & how i can get back my Advance money & also get him punished for harassing us in this manner as we are put to lot of hardship getting a new house on rent immediately & shifting with such short instance.
