i am a 30yr old married girl file a 498 an 125 case against my husband. am leaving at my old parents home with 3 brothers and 3 bhabhi and their kids from last 4 yrs..my husband not giving me maintenance.now my brothers r not ready to keep me with them..my parents r bedridden and sufuring from many decease. thats y they cant fight with my brothers for me. my papa had made all property with hard work..now how can i survive ? can i demand for any property from my papa? what should be the justice for me?

If the property is self earned by your father then you cannot demand but if it is ancestoral then you can claim your right.

Rest you can file maintenance from your husband and definately you have full right to get the same.

If property is purchased by your father with his money than you can't demand it. But after death of your father you can entitled to get your share from it.

You will get intreme maintance from your husband and now you can file case for domestic Violance.

Don't go to the court against your father it will harmful for you.wait till his death then you can cliam property from your brothers. Otherwise you can file a case in Domestic Violence Act against your father and brother for protection.

You may be legally entitled to live with your parents as a dependent so long as you do not receive maintenance from your husband.

You should pursue your remedy against your husband for maintenance under HMA, Cr. P. C. and the Domestic Violence Act.
