Legal Question in Real Estate Law in India

Agriculture land contract term (Old Contract-New Contract)

There is an agriculture land located in Gujarat State in India. According to the law of Gujarat government the land has been converted into old contract from new contract. I want to know the contract term i.e. what is old contract or what is new contract in agriculture land in Gujarat? What is the difference between old and new contract?

I believe you are referring to Land Tenure.

You need to read the terms of grant on new tenure with grant on old tenure to know exact conditions.

Generally, old tenure denotes freehold & transferable lands, while new tenure denotes restrictions on transfer of land.

Re: Agriculture land contract term (Old Contract-New Contract)

'Tenure' is the right word not Contract.

But anyways the differance between Old Tenure and New Tenure Land is as below:

(1) You can sell Old Tenure Land without any sanction letters of Goverment permission.

(2) In case of New Tenure Land you have to pay 80% premium to the Goverment in case of sale or construction.

(3) The new tenure land has got many restrictions when you deal.

In case of need please contact personally.

Re: Agriculture land contract term (Old Contract-New Contract)

The appropriate word is not contract, but it is Tenure. It is called old Tenure land and New Tenure Land. If the land is old tenure, then you can sell the same without any government sanction or permission, and if it New Tenure, then you cannot sell it without government permission. Over and above there are many other restriction while dealing with New Tenure land, however it is not the case with Old Tenure Land.
