Legal Question in Real Estate Law in India

My father expired 13 years ago and a land of 266sq yards that was on his name was not transferred to my mother's name. Can you please let me know the procedure to get the property under my Mother's name. We are three brothers and all of us are willing to make our mother as the owner of the property.

a petition for succession may be filed and the sons may consent for transfer of rights in the name of mother.

You approach the revenue authorities in your area where the property is situated alongwith the death certificate and legal heirship certificate. Ask for mutation of the property in your names. After the same is done you can execute a relinquishment deed or release deed releasing your rights in favour of your mother with the sub-registrar.
