Legal Question in Real Estate Law in India

forming the society

Dear Sir,

I have purchased a flat in Kharghar, navi mumbai in march 2005, got possession in June 2005, Received Occupancy certificate from CIDCO in October 2005, Occupancy of our building is almost 75 to 80% , but till date our Builder is not forming the society. He is taking Re. 1/- per sq.ft. of Built-up area (only in cash without any receipt) against maintenance charge from us from the date of possession.

Please advice on the same. Any legal obligations of time to form the society by the builder?
